Does mutual acceptance count as Day 1?
Against Form 21 Rev. 2/26

Short answer
Usually, no. Under NWMLS Form 21 Rev. 2/26, the mutual-acceptance date is Day 0. Counting starts afterward, but whether weekends and holidays count depends on the deadline stated in your contract. Your signed agreement and written modifications control.
DateHog reads the mutual-acceptance date and prepares your deadline timeline. Unclear contracts go to human review. No account required.
Try It01 / A Seattle story
Sarah’s house, Maya’s offer, and the day the clock began.
Sarah is selling a fictional house in Seattle’s Ballard neighborhood. Her agent lists it for $1 million, and the home appears on sites such as Zillow and Redfin. Maya sees the listing and wants to buy it.
Maya signs a written offer for $950,000. Her agent delivers it to Sarah’s agent.
Sarah likes Maya’s offer but wants $980,000. Sarah signs a written counteroffer and it is delivered back to Maya. They do not yet have mutual acceptance.
Maya tells her agent that $980,000 works. That conversation explains what she wants, but it is not the completed acceptance.
Maya signs Sarah’s $980,000 counteroffer without changing anything.
Maya’s signed acceptance is delivered. This is the moment the parties have mutual acceptance.
The day after mutual acceptance. This is where the contract’s counting rules begin.
No. Washington recognizes electronic records and electronic signatures when the parties agree to transact electronically. In practice, agents normally use the current purchase-and-sale and counteroffer forms with an electronic-signature service, then deliver the completed document electronically. A casual email, text, or WhatsApp message is a risky substitute: it may not contain the required property description and material terms, show an intent to sign, establish who acted, or follow the agreement's delivery requirements.
What date follows mutual acceptance?
Use U.S. month/day/year format, for example 10/13/2026.

This example uses one starting date. Your agreement may contain inspection, earnest-money, financing, and closing deadlines.
Try It02 / Late delivery
Does acceptance after 9:00 p.m. move mutual acceptance to the next day?
Washington REALTORS explains that mutual acceptance occurs on the date agreement is reached, regardless of the time of day the last required signature is delivered. If an offer or counteroffer remains open and proper delivery occurs at 11:30 p.m. Wednesday, mutual acceptance occurs Wednesday.
The result changes if the offer has already expired. Washington REALTORS gives the example of a seller accepting at 10:00 p.m. when the buyer's offer expired at 9:00 p.m. In that situation, there is no mutual acceptance.
A late-evening delivery does not automatically move mutual acceptance to the next day. The accepted offer or counteroffer must still be effective, and the agreement's delivery requirements must be satisfied.
03 / Weekends
Do weekends count after mutual acceptance?
Paragraph l of NWMLS Form 21 Rev. 2/26 excludes Saturdays, Sundays, and Washington legal holidays from periods of five days or less. Longer periods count calendar days, with a rollover when the last day falls on an excluded day. The agreement can specify a different rule, and signed addenda or amendments can change a deadline.
That is why a Friday mutual acceptance cannot be converted into every deadline merely by adding a fixed number of calendar days. First identify the applicable period and the language in the signed agreement; then apply the correct counting rule.
04 / Avoid errors
Four common counting mistakes
- Counting the mutual-acceptance date as Day 1.
- Using the signature date when proper delivery occurred later.
- Assuming a delivery after 9:00 p.m. always shifts mutual acceptance.
- Applying the same weekend rule to every contractual period.
